P 4710 Resignation: Certificated Staff

Certificated employees who for any reason intend to retire or resign at the end of the current school year are encouraged to indicate their plans in writing to the Board as early as possible, but no later than June 1.

To be paid for any professional leave days accumulated, the employee must notify their direct supervisor in writing of their intention to retire prior to March 15.  If the 15th falls on a weekend, the Friday prior to the 15th will be the last day.

Resignations to become effective during the school year require a release by the Board and must be considered on an individual basis. Letters of resignation shall be submitted to the Superintendent/designee and the principal/supervisor. The letter should state reasons and an effective date for the resignation.

Once under contract, only the Board has the authority to release an employee from a contract. After an employee has signed and returned his or her contract, or in the case of a tenured teacher or any administrator, after June 1, an employee will fulfill the responsibilities of his or her contract.

The Board reserves the right to pursue all available legal remedies when an employee breaks a contract with the District including, but not limited to, filing charges to have a teaching certificate or professional license revoked or seeking a monetary judgment.

Should an employee wish to be released after having signed a contract, or in the case of a tenured teacher, after June 1, the release will be granted upon approval by the Board and the payment of liquidated damages.

The following schedule of damages has been established by the Board and reflects the approximate additional cost that will be incurred by the District in replacing the employee.

Date of Resignation and Amount of Damages Assessed                                                     

After contract is signed through June 15th (non-tenured teacher only):  $1,500

June 2nd-June 15th (tenured teacher/any administrator):  $1,500

June 16th-July 31st:  $2,000

August 1st or later:  $3,000
