R 2610 Misconduct and Disciplinary Consequences

It is the objective of the administration to provide a climate for learning for all students enrolled at Glasgow Schools. Unfortunately there are times when unacceptable student behavior interferes with the educational process and disciplinary actions are necessary. It therefore is the goal of this policy to develop positive and acceptable behavior changes in those students who act irresponsibly. This policy governs students at anytime while they are on school property, at school sponsored activities or events (home or away), or in any vehicle being used to transport students. This policy also includes personal vehicles while on school property. Any conduct not included herein, or an aggravated circumstance of any offense or an action involving a combination of offenses may result in disciplinary consequences that extend beyond this code of conduct as determined by the principal, superintendent, and/or Board of Education. The following options are available for each offense.

*With each offense, the administrator will:

conference with the offender(s)
contact a parent or guardian via phone call or letter home
document the behavior(s) and actions taken

  1. VIOLATIONS AGAINST PERSONS
    1. Assault (Refer to Policy and Regulation 2673)
      Use of physical force with the intent to do bodily harm.
      • 1st Offense: 1-10 days in-school suspension and/or 1-10 days out-of-school suspension, or expulsion; possible notice to law enforcement officials.
      • 2nd Offense: 2-10 days in-school suspension and/or 2-10 days out-of-school suspension, or expulsion; possible notice to law enforcement officials.
      • Subsequent Offense: 11-180 days out-of-school suspension or expulsion; notification to law enforcement officials.
    2. Fighting
      Mutual combat in which both parties have contributed to the conflict, either verbally or by physical action.
      • 1st Offense: 1-3 days in-school suspension and/or 1-3 days out-of-school suspension; possible notification of law enforcement officials.
      • 2nd Offense: 2-10 days in-school suspension and/or 1-10 days out-of-school suspension; possible notification of law enforcement officials.
      • Subsequent Offense: 2-10 days in-suspension, 1-180 days out-of-school suspension or expulsion; possible notification of law enforcement officials.
    3. Weapon (Refer to Board Policy 2620)
      1. Possession or use of any instrument or device which is customarily used for attack or defense against another person; any instrument or device used to inflict physical injury to another person (other than those defined in 18 U.S.C. 921 or §571.010, RSMo).
        • 1st Offense: 1-10 days in-school suspension and/or 1-180 days of out-of-school suspension or expulsion; possible notification of law enforcement officials.
        • Subsequent Offense: 11-180 days out of school suspension or expulsion; possible notification of law enforcement officials.
      2. A student shall not possess, handle, or use as a weapon; dangerous knives, razors, fireworks, explosives, guns, or any other objects that reasonably can be considered weapons (specifically defined in 18 U.S.C. 921 or any instrument or device defined in §571.010 RSMo).  
        • 1st Offense: One calendar year suspension or expulsion; notification of law enforcement officials.
    4. Verbal Abuse to Staff
      Disrespectful verbal, written or symbolic language or gesture which is inappropriate to public settings directed at a staff member.
      • 1st Offense: 1-3 days of detention, 1-3 days in-school suspension and/or 1-3 days out-of-school suspension.
      • 2nd Offense: 1-3 days detention, 1-10 days in-school suspension and/or 1-10 days out-of-school suspension.
      • Subsequent Offense: 2-10 days in-school suspension and/or 1-180 days out-of-school suspension, or expulsion.
    5. Threatening/Intimidating Behavior or Language & Bullying
      Use of verbal or written threats to do bodily harm or use of body to physically harm (see Policy 2655).
      • 1st Offense: 1-3 days detention, 1-3 days in-school suspension and/or 1-3 days out-of-school suspension; possible notice to law enforcement officials.
      • 2nd Offense: 1-3 days detention, 1-10 days in-school suspension and/or 1-10 days out-of-school suspension; possible notice to law enforcement officials.
      • Subsequent Offense: 2-10 days in-school suspension,1-180 days out-of-school suspension, or expulsion; notification to law enforcement officials.
    6. Sexual Harassment (Refer to Board Policy 2130)
      1. Use of sexually intimidating verbal, written, or symbolic language, objects or pictures.  
        • 1st Offense: 1-3 days in-school suspension and/or 1-3 days out-of-school suspension; possible notification of law enforcement officials.
        • 2nd Offense: 1-10 days in-school suspension and/or 1-10 days out-of-school suspension; possible notification of law enforcement officials.
        • Subsequent Offense: 2-10 days in-school suspension, 1-180 days out-of-school suspension or expulsion; possible notification of law enforcement officials.
      2. Physical touching of another person in the area of the breasts, buttocks, or genitals.  
        • 1st Offense: 1-10 days in-school suspension and/or 1-10 days out-of-school suspension or expulsion; possible notification of law enforcement officials.
        • 2nd Offense: 2-10 days in-school suspension and/or 2-10 days out-of-school suspension or expulsion; possible notification of law enforcement officials.
        • Subsequent Offense: 11-180 days out-of-school suspension or expulsion; possible notification of law enforcement officials.
  2. VIOLATIONS AGAINST PUBLIC HEALTH AND SAFETY
    1. Drugs/Alcohol
      1. Possession of or attendance under the influence of any unauthorized prescription drug, alcohol, narcotic substance, counterfeit drugs or drug related paraphernalia including controlled substances and illegal drugs defined in Section 202 of the Controlled Substance Act.
        • 1st Offense: 1-180 days out-of-school suspension; notification of law enforcement officials.
        • Subsequent Offense: 11-180 days out-of-school suspension or expulsion; notification of law enforcement officials.
      2. Sale, purchase or distribution of any prescription drug, alcohol, narcotic substance, counterfeit drugs and/or drug paraphernalia including controlled substances and illegal drugs defined in Section 202 of the Controlled Substance Act.
        • 1st Offense: 1-180 days out-of-school suspension or expulsion; notification of law enforcement officials.
        • Subsequent Offense: Expulsion; notification of law enforcement officials.

      The administration may discipline students for the above offenses and based on prudent reasonable suspicion.If parents provide medical/laboratory tests which proves no drug/alcohol violation, then the disciplinary action will be rescinded.

    2. Tobacco/Vaping
      Students are not permitted to have in their possession, smoke, or use tobacco or vaping products in any of the school buildings, on school grounds, or at any school sponsored activity.Cigarettes or other tobacco products will be taken from the student and will not be returned.
      • 1st Offense: 3 days in-school suspension and/or 3 days out-of-school suspension.
      • 2nd Offense: 5 days in-school suspension and/or 5 days out-of-school suspension.
      • Subsequent Offense: 6-10 days out-of-school suspension.
  3. VIOLATIONS AGAINST PROPERTY
    1. Extortion
      Threatening or intimidating any student for the purpose of, or with intent of, obtaining money or anything of value from the student.
      • 1st Offense: 1-3 days in-school suspension and/or 1-3 days out-of-school suspension; possible notification of law enforcement officials.
      • 2nd Offense: Principal/student conference, in-school suspension and/or 1-10 days out-of-school suspension; possible notification of law enforcement officials.
      • Subsequent Offense: 2-10 days in-school suspension and/or 1-180 days out-of-school suspension, or expulsion; possible notification of law enforcement officials.
    2. Theft
      Stealing or attempting to steal private or school property.
      • 1st Offense: Restitution, 1-5 days in-school suspension and/or 1-5 days out-of-school suspension or expulsion; possible notification to law enforcement officials.
      • 2nd Offense: Restitution, 2-10 days in-school suspension and/or 1-180 days out-of-school suspension or expulsion; possible notification to law enforcement officials
      • Subsequent Offense: Restitution and/or 11-180 days out-of-school suspension or expulsion, notification to law enforcement officials.
    3. Vandalism
      Any student who willfully causes substantial damage or attempts to cause substantial damage to any property, real or personal belonging to the school, staff or students.
      • 1st Offense: Restitution, 1-5 days in-school suspension and/or 1-5 days out-of-school suspension or expulsion; possible notification to law enforcement officials.
      • 2nd Offense: Restitution, 2-10 days in-school suspension and/or 1-180 days of out-of-school suspension or expulsion; possible notification to law enforcement officials.
      • Subsequent Offense: Restitution and/or 11-180 days out-of-school suspension orexpulsion; notification to law enforcement officials.
    4. Arson
      Intentionally causing or attempting to cause a fire or explosion.
      • 1st Offense: 11-180 days out-of-school suspension or expulsion, notification to law enforcement officials.
      • Subsequent Offense: Expulsion, notification to law enforcement officials.
  4. TRUANCY (See Policy & Regulation 2340)
    Absence from school without the knowledge and consent of parents/guardians and/or the school administration.
      • 1st Offense: Student will stay in after school detention twice the length of time the student was absent without an excuse and/or 1-3 days in-school suspension.
      • 2nd Offense: Detention and/or 1-3 days in-school suspension.
      • Subsequent Offense: Detention, 3-10 days in-school suspension; notification of law enforcement officials.
  5. VIOLATIONS AGAINST PUBLIC DECENCY AND GOOD ORDER
    1. Use of Language that is Disparaging or Demeaning
      Use of hate language to demean other persons due to their race, gender, disability, natural origin, or religious beliefs.
      • 1st Offense: 1-3 days in-school suspension and/or 1-3 days out-of-school suspension.
      • 2nd Offense: 1-10 days in-school suspension and/or 1-10 days out-of-school suspension.
      • Subsequent Offense: 2-10 days in-school suspension and/or 1-180 days out-of-school suspension, or expulsion; possible notification of law enforcement officials.
    2. Use of Disruptive Speech or Conduct
      Conduct or speech, be it verbal, written or symbolic, which materially and substantially disrupts classroom work, school activities, or school functions; or simply talking in class when told not to do so.
      • 1st Offense: 1-3 days in-school suspension and/or 1-3 days out-of-school suspension.
      • 2nd Offense: 1-10 days in-school suspension and/or 1-10 days out-of-school suspension.
      • Subsequent Offense: 2-10 days in-school suspension and/or 1-180 days out-of-school suspension, or expulsion; possible notification of law enforcement officials.
    3. Bus Misconduct
      Any offense committed by a student on a district-owned or contracted bus shall be punished in the same manner as if the offense had been committed at the student’s assigned school.In addition, bus riding privileges may be suspended or revoked. (See Bus Conduct Rules and Disciplinary Guidelines).
      • 1st Offense: Warning and/or 1-3 days in-school suspension.
      • 2nd Offense: 3 days suspension of bus riding privileges.
      • Subsequent Offense: 4-10 days suspension of bus riding privileges or permanent suspension of bus riding privileges.
    4. False Alarms
      Tampering with emergency equipment, setting of false alarms, making false reports.
      • 1st Offense: 1-3 days in-school suspension and/or 1-3 days out-of-school suspension; possible notification of law enforcement officials.
      • 2nd Offense: 1-10 days in-school suspension and/or 1-10 days out-of-school suspension; possible notification of law enforcement officials.
      • Subsequent Offense: 2-10 days in-school suspension and/or 1-180 days out-of-school suspension, or expulsion; possible notification of law enforcement officials.
    5. Improper Displays of Affection
      Physical contact which is inappropriate for the school setting which includes consensual kissing, fondling, or embracing.
      • 1st Offense: 1-3 days detention, 1-3 days in-school suspension and/or 1-3 days out-of-school suspension.
      • 2nd Offense: 1-3 days detention, 1-10 days in-school suspension and/or 1-10 days out-of-school suspension.
      • Subsequent Offense: 2-10 days in-school suspension and/or 1-180 days out-of-school suspension, or expulsion; possible notification of law enforcement officials.
    6. Inappropriate Use of Technology

      Student-use of cell phones or other electronic devices is limited upon entering the school building and during the school day.  If the devices are present on campus, students must display responsible use of electronic devices at appropriate times.  Passing times between classes and at lunch will be considered appropriate times of use.  Cell phones are banned in all restrooms as well as in dressing areas including during extracurricular activities.  Students must obtain permission from teachers or administration for use during non-designated times and locations.  Teachers may collect cell phones from students or the entire class to enable students to focus on learning and/or during assessments.  *Elementary – 8th Grade students will not be allowed to use cell phones from the beginning of the school day to the last bell of the day.

      • 1st Offense: Device will be taken, student may pick it up at the end of the school day.  Warning, detention, 1-3 days in-school suspension, and/or 1-3 days out-of-school suspension.
      • 2nd Offense: Device confiscated until a parent/guardian can retrieve device from school, detention, 1-10 days in-school suspension, and/or 1-10 days out-of-school suspension.
      • Subsequent Offense: Device confiscated until a parent/guardian can retrieve device from school and 1-10 days in-school suspension, and/or 1-10 days out-of-school suspension.
  6. ACADEMIC DISHONESTY OR ACADEMIC MISCONDUCT
    1. Academic dishonesty or academic misconduct is any type of cheating that occurs in relation to a formal academic exercise. It can include:
      • Plagiarism: The adoption or reproduction of original creations of another author (person, collective, organization, community or other type of author, including anonymous authors) without due acknowledgment.
      • Fabrication: The falsification of data, information, or citations in any formal academic exercise.
      • Deception: Providing false information to an instructor concerning a formal academic exercise - e.g., giving a false excuse for missing a deadline or falsely claiming to have submitted work.
      • Cheating: Any attempt to give or obtain assistance in a formal academic exercise (like an examination) without due acknowledgment.
      • Bribery: or paid services. Giving assignment answers or test answers for money.
      • Sabotage: Acting to prevent others from completing their work. This includes cutting pages out of library books or willfully disrupting the experiments of others.
      • Professional misconduct: Professional acts that are academically fraudulent equate to academic fraud and/or grade fraud.
      • Impersonation: assuming a student’s identity with intent to provide an advantage for the student.  
        • 1st Offense: automatic zero on assignment or 3 days ISS.
        • 2nd Offense: automatic zero on assignment or 6 days ISS.
        • 3rd Offense: automatic zero on assignment or 10 days OSS.
        • 4th Offense: automatic zero on assignment or 11-90 days OSS.
