R 4710 Resignation: Certificated Staff

Certificated employees who wish to resign should address a letter of resignation to the superintendent with a copy to the principal.  The letter should state reasons and an effective date for the resignation.  Teachers who resign after honoring the terms of their contracts can return unused accumulated sick leave days at a rate of fifty percent (50%) of their average daily pay over the previous five (5) years.

Teachers should assure themselves that they understand the contract they have signed; they have the responsibility to honor the terms of the contract.  In the event it becomes necessary for a teacher to request release from the contract, one of the following procedures will be followed:

  1. EMERGENCY RELEASE
    1. The teacher must submit a written request for release as soon as a known emergency exists.
    2. The Board considers  the following situations as emergencies:
      1. Personal illness
      2. Family illness
      3. Transfer of spouse
      4. Other mutually agreed-upon personal reasons
    3. The teacher will be released without fine, revocation of certificate or other punitive measures when both parties agree that the release is an emergency.
  2. NON-EMERGENCY RELEASE
    1. The teacher must submit a written request for release at least thirty (30) days prior to the requested release date.
    2. A release from the contract may be approved if a suitable replacement can be found prior to June 1.
    3. After June 1, the approval of the release is dependent, among other factors, on the Board finding a suitable replacement.  The Board may also assess a penalty, based on the following schedule: 
      1. Date of Signed Contract - May 31 - $500
      2. June 1 to July 31 - 10% of contract
      3. Later than August 1 - 20% of contract
    4. If the teacher has complied with applicable provisions of this policy the teacher may not be subject to certificate revocation procedures or other punitive action.
    5. If the teacher fails to comply with the provisions of this policy (the Board of Education does not receive written communication regarding release form contract as stated in (a) above or violation of (b) and (c) above, the teacher will be subject to penalty, including license revocation.
