Certificated employees who wish to resign should address a letter of resignation to the Superintendent with a copy to the principal/supervisor. The letter should state the reasons and effective date for the resignation.
On occasion, employees may wish to approach the Board of Education requesting to be released from their existing contractual commitments contracts to seek employment with other school districts or in other fields. The Board strongly discourages such requests. The Board expects its employees to honor their contractual commitments.
If the Board of Education decides that it is in the District’s best interest to release a certificated employee from an existing contractual commitment, the Board may, at its discretion, permit such release if (1) the Superintendent advises the Board that a suitable replacement is likely to be found during the summer period before the beginning of school, and (2) the certificated employee pays the District the respective sum listed below. Such sum will serve as legal consideration for being released from the contract and, additionally, will assist the District in defraying its expenses incurred in searching for a replacement employee. This sum shall be calculated by referencing the date upon which the request is submitted and the applicable percentage of the total compensation under the contract from which the employee is seeking to be released:
Probationary Teacher | |
Date of execution to June 15 | 5% of contracted amount |
June 16 to July 15 | 7.5% of contracted amount |
After July 15 | 10% of contracted amount |
Tenured Teacher | |
June 2 to June 15 | 5% of contracted amount |
June 16 to July 15 | 7.5% of contracted amount |
After July 15 | 10% of contracted amount |
Principal/Administrator | |
Date of execution to April 15 | 5% of contracted amount |
June 16 to July 15 | 7.5% of contracted amount |
After July 15 | 10% of contracted amount |
Superintendent | |
Contract date to Mar. 15 | 5% of contracted amount |
Mar. 16 to May 15 | 7.5% of contracted amount |
After May 15 | 10% of contracted amount |
Certified employees who wish to be released from their contracts in accordance with this payment method must request such a release in letter format and submit the request to the Superintendent.
The above sum must be paid prior to the employee’s release from the contract or will be deducted from the employee’s final check, whichever the employee prefers.
Individual requests by certificated staff to be released from a contract for reasons other than seeking employment elsewhere will be addressed by the Board on a case-by-case basis. The Board may, at is discretion, waive the above sum when exceptional circumstances exist. However, waivers of the above sum shall not be routine.
The District will initiate proceedings to seek revocation of DESE licensure if an employee abandons a contract in violation of this regulation.
