The discipline code set out in this regulation is intended to be illustrative but not an exclusive listing of acts of misconduct and the consequences for each. Misconduct which is not specifically listed in this regulation may be deemed to warrant discipline up to and including expulsion following provision of all due process procedures. In addition, the disciplinary consequence listed for each offense may be increased or decreased by the Administration or the Board of Education due to mitigating or aggravating circumstances.
Copies of this regulation or the student handbook which includes the code of student conduct and disciplinary consequences will be provided to each student at the beginning of each school year. Copies of these documents will also be available for public inspection during normal business hours in the Superintendent's office.
Alcohol - Possession of or presence under the influence of alcohol regardless of whether the student is on school premises
First Offense: 10 days OSS pending long term suspension review by supt. + notification of law enforcement
Subsequent Offenses: OSS long term + notification of law enforcement + student/parent meeting with school board
Assault/Fighting/Hazing - (Refer to Policy and Regulation 2673- Reporting of Violent Behavior) Use of physical force with the intent to do bodily harm.
First Offense: Minimum 3 days OSS
Subsequent Offenses: 2nd - minimum 5 days OSS; 3rd - 10 days OSS pending long term suspension review
Physical Assault of School Personnel - Use of physical force with the intent to do bodily harm to a school staff member.
First Offense: 10 days OSS pending long term suspension review by supt.
Bullying/Harassment - Intentional intimidation or infliction of physical, emotional, or mental harm (see Policy 2655).
Cell Phone/Personal Electronics - Display or use of electronic personal communications device (a portable device that is used to initiate, receive, store, or view communication, information, images, or data electronically)
First Offense: Cell Phone/Personal Property will be confiscated and returned only to the student at the end of the school day.
Second Offense: Cell Phone/Personal Property will be confiscated and returned only to the student’s parent/guardian. The student will serve 1 day of ASD.
Third Offense: Cell Phone/Personal Property will be confiscated and returned only to the student’s parent/guardian after a conference with the building administrator. The student will also serve 2 days of ASD.
Subsequent Offenses: Cell Phone/Personal Property will be confiscated and returned only to the student’s parent/guardian after a conference with the building administrator. The student will serve an additional day of ASD per offense, or be subjected to further disciplinary action as determined by the administrator.
Defiance of Authority - Refusal to obey directions or defiance of staff authority
First Offense: Minor - 1-3 days ASD/ISS; Major - 1-3 days OSS
Subsequent Offenses: 2nd Minor - 3-5 days ASD/ISS; 2nd Major - 5 days OSS; 3rd - 10 days OSS pending long term suspension review by supt.
Disruptive Behavior - Conduct which has the intentional effect of disturbing education or the safe transportation of a student
First Offense: 1-3 day ASD/ISS
Subsequent Offenses: 2nd - 3-5 days ISS; 3rd+ - up to 10 days OSS
Drugs/Controlled Substance/Alcohol/Prescription Medication
Possession or presence under the influence of a controlled substance or substance represented to be a controlled substance while at school, on the school playground, on the school parking lot, a school bus or at a school activity whether on or off of school property.
First Offense: minimum of 10 days OSS pending long term suspension review by supt. + report to police officials + parent/student conference with school administration
Subsequent Offenses: 2nd - 10 days OSS pending long term suspension review by supt. + report to police officials; 3rd - automatic long term OSS/expulsion + report to police officials
Sale/Distribution of a controlled substance or substance represented to be a controlled substance while at school or at any of the locations described above.
First Offense: 10 days OSS pending long term suspension review by supt. + report to police officials;
Subsequent Offenses: automatic long term OSS/expulsion + report to police officials
Extortion - Verbal threats or physical conduct designed to obtain money or other valuables
First Offense: Restitution + 1-5 days ISS
Subsequent Offenses: 2nd - Restitution + up to 10 days OSS; 3rd - Restitution + 10 days OSS pending long term suspension review by supt.
Firearms and Weapons (Refer to Policy and Regulation 2620 - Firearms and Weapons in School) Possession of a firearm or weapon while at school, on the school playground, on the school parking lot, a school bus or at a school activity whether on or off of school property.
First Offense: OSS to expulsion + referral to law enforcement
Improper Display of Affection - Consensual kissing, fondling, or embracing
First Offense: conference w/ possible ASD/ISS
Subsequent Offenses: 2nd - 1-3 days ASD/ISS; 3rd - 3-5 days ASD/ISS; 4th - 1-5 days OSS
Improper Language
Threatening Language - Use of verbal, physical or written threats to do bodily harm to person or personal property.
First Offense: Minor - 1-3 days ASD/ISS; Major - 1-3 days OSS
Subsequent Offenses: 2nd Minor - 3-5 days ASD/ISS; 2nd Major - 5 days OSS; 3rd - 10 days OSS pending long term suspension review by supt.
Use of Obscene or Vulgar Language - Language which depicts sexual acts, human waste, and blasphemous language or profanity
First Offense: Minor - 1-3 days ASD/ISS; Major - 1-3 days OSS
Subsequent Offenses: 2nd Minor - 3-5 days ASD/ISS; 2nd Major - 3-5 days OSS; 3rd Minor - 1-5 days OSS; 3rd Major - 5-10 days OSS; 4th+ - minimum 10 days OSS pending long term suspension review by supt.
Inappropriate Sexual Conduct
Physical touching of another student in the area of the breasts, buttocks, or genitals
First Offense: 1-10 days OSS + report to police officials
Subsequent Offenses: 10 days OSS pending long term suspension review by supt + report to police officials
Use of sexually intimidating language, objects, or pictures.
First Offense: 3-5 days ASD/ISS
Subsequent Offenses: 2nd - 1-10 days OSS; 3rd - 10 days OSS pending long term suspension review by supt. + report to police officials
Indecent Exposure - Includes display of breasts, buttocks and genitals in a public
location
First Offense: 1-3 days OSS
Subsequent Offenses: 2nd - 3-5 days OSS; 3rd - 10 days OSS pending long term suspension review by supt.
Theft - Nonconsensual taking or attempt to take the property of another
First Offense: Pay for/replace items + 1-3 days OSS + possible referral to law enforcement
Subsequent Offenses: 2nd - Pay for/replace items + 3-5 days OSS + possible referral to law enforcement; 3rd - Pay for/replace items + 10 days OSS pending long term suspension review by supt. + referral to law enforcement
Tobacco/Vaping - Possession or use of tobacco, tobacco products, vapes, or e-cigarettes
First Offense: Confiscation + 3 days OSS
Subsequent Offenses: 2nd - Confiscation + 5 days OSS; 3rd - Confiscation + 10 days OSS pending long term suspension review by supt.
Truancy - Absent or tardy from class or classes without authorization (See also Policy and Regulation 2340 - Truancy and Educational Neglect.)
First Offense: 1-3 days ASD/ISS
Subsequent Offenses: 2nd - 3-5 days ASD/ISS; 3rd - 1-3 days OSS; 4th - 3-5 days OSS
Vandalism/Arson - Intentional damage or attempt to damage property belonging to the
staff, students, or the District
First Offense: Restitution + 1-10 days OSS depending on severity + possible referral to law enforcement
Subsequent Offenses: Restitution + 10 days OSS pending long term suspension review by supt. + referral to law enforcement
