R 2610 Misconduct and Disciplinary Consequences

The discipline code set out in this regulation is intended to be illustrative but not an exclusive listing of acts of misconduct and the consequences for each. Misconduct which is not specifically listed in this regulation may be deemed to warrant discipline up to and including expulsion following provision of all due process procedures. In addition, the disciplinary consequence listed for each offense may be increased or decreased by the Administration or the Board of Education due to mitigating or aggravating circumstances.

Copies of this regulation or the student handbook which includes the code of student conduct and disciplinary consequences, as well as the District's corporal punishment policy, if any, will be provided to each student at the beginning of each school year. Copies of these documents will also be available for public inspection during normal business hours in the Superintendent's office.

Automobile Violation/Careless Driving:

First Offense: Student and parent notification

Second Offense: 3 day suspension  of driving privilege

Third Offense: Loss of driving privilege for remainder of school year

Bullying:

Bus Rules and Regulations:

The bus rules shall be posted on the front inside of the bus. The student is responsible for following these rules at all times while riding the bus. Students riding the buses shall be under the jurisdiction and control of drivers and will be denied riding privileges if they do not conduct themselves according to the posted rules.  The following is a list of Wheaton R-III Bus Rules.        

  1. Talk in low or normal tones. Never talk loud or shout.
  2. Fighting or scuffling in the bus or at the bus stop is never permitted.
  3. Never eat or drink on the bus.
  4. Tobacco is not permitted on the school bus by any student at any time.
  5. Stay in your seat as long as the bus is in motion. Do not change seats without the bus driver’s permission.
  6. Keep the bus clean. Never throw paper or other objects on the bus or out the bus windows.
  7. Keep your head, hands, feet, etc. inside the bus. Keep your feet on the floor.
  8. Obscene or profane language, gestures, remarks or signs are not permitted at any time.
  9. Be courteous to the driver and always obey the driver. Always cooperate with the driver.
  10. The bus driver may assign seats.
  11. Always be on time; never deliberately delay loading or unloading of the bus.
  12. Be careful and never destroy school property. Deliberate destruction of property may result in suspension from the bus, plus the responsibility to pay for the damage.
  13. Possession of alcohol or a controlled substance without a prescription is prohibited.
  14. Students are never to bring a knife to school. Pencils and pens are to be kept in your pocket or a container.
  15. No spitting on or from the bus.
  16. Any conduct that is prejudicial to the maintenance of good order and bus safety will not be permitted.
  17. All bus rules also apply to extracurricular activities.

Cheating:

First Offense: Grade of zero

Second Offense: Grade of zero and ASD (1- 5)

Third Offense: Grade of zero and ASD or OSS

Classroom Disturbance/Inappropriate Behavior (Classroom/hallways):  Conduct/speech which materially/substantially disrupts/interferes with orderly educational process in the classroom including sleeping in class.

First Offense: ASD (1 - 3)

Second Offense: ASD (2 - 5)

Third Offense: OSS up to 10 days

Fourth Offense: OSS up to 10 days

Computer Usage Violation:

First Offense: Minor: 10 day computer log-on suspension Major: Up to 25 day computer log-on suspension

Second Offense: 25 day computer suspension

Third Offense: Permanent computer usage suspension for remainder of school year

Defiance/Disrespect for school personnel:

First Offense: Minor: ASD (1 - 5) Major: Minimum OSS (1 - 3)

Second Offense: Minor: ASD (2 - 5) Major: 5 OSS

Third Offense: 10 OSS plus long term suspension/expulsion review by Supt.

Destruction of Property:

First Offense: Unintentional: Pay for the damages Intentional: Minor-Pay for the damages, 1 ASD Major-Pay for damages, up to 10 OSS

Second Offense: Pay for damages plus OSS (1 - 10)

Third Offense: Pay for damages, 10 OSS plus long term suspension/expulsion review by Supt.

Dress Code Violation:

First Offense: Parent call, Student Conference and send home as an unexcused absence to change.

Second Offense: Parent call, Student Conference and send home as an unexcused absence to change + 1 ASD

Electronic Devices:  Cellular telephones, cameras, games or any such items are not to be used or seen at any time during the school day between 8:20 a.m. and 3:14 p.m. and shall be confiscated if seen.  This includes text messaging, talking, calculator uses or any other function of a cellular device.  Ipods, CD players and radios are allowed during lunch and passing times.  No Electronic Devices are allowed during class time.  Devices of this nature are deemed a distraction  to the learning environment.  Allowance of such items on school-sponsored trips will be left up to the coach or sponsor.

First Offense:  Item will be confiscated.  Student may pick up item from building princpal at the end of the school day.

Second Offense:  Item will be confiscated.  Item will be returned only to the student’s parent after a conference with the building administrator.

Third Offense:  Item will be confiscated.  Item will be returned at the end of the school year.  Student will be subjected to further disciplinary action.

Excessive Horseplay & GENERAL MISBEHAVIOR IN HALLS, CLASSROOMS, LUNCH ROOM, OR LOCKERROOM: (This includes all things done “just kidding” around like punching, kicking, tripping, etc.)

First Offense: Minimum of 1 hour ASD

Second Offense: ASD (1 - 5)

Third Offense: Minimum of 3 days OSS

Extortion:

Threatening or intimidating any person for the purpose of, or with the intent of obtaining money or something of value from the other person.

First Offense: Restitution and ASD (1 - 5)

Second Offense: Restitution and up to 10 OSS

Third Offense: Restitution and 10 OSS plus long term suspension/expulsion review by Supt.

Fighting/Physical Assault/Hazing:

First Offense: Minimum 3 OSS

Second Offense: Minimum 5 OSS

Third Offense: 10 OSS and/or recommend long term suspension/expulsion

General Misbehavior:

First Offense: ASD (1 - 5)

Second Offense: ASD (2 - 5)

Third Offense: Up to 10 days OSS

False Report:

Making a false report which is disruptive of a threat to health, safety, and good order, i.e. fire alarm or bomb threat.

First Offense: 10 days OSS and/or recommend long term suspension/expulsion review by Supt.

Forgery:

First Offense: ASD (1 - 5) plus call parents

Second Offense: ASD (2 – 5)

Third Offense: 1 OSS

Fourth Offense: 3 OSS

Gambling:

First Offense: ASD (1 - 5)

Second Offense: ASD (2 - 5) or OSS up to 10 days

Third Offense: OSS up to 10 Days

Guns/Weapons:

First Offense: Recommend expulsion Referral to law enforcement

Inciting a public disturbance:

First Offense: ASD (1 - 5) Possible loss of privilege to attend (Sem/Yr)

Second Offense: OSS up to 10 days, loss of privilege to attend (Sem/Yr)

Third Offense: 10 OSS plus long term suspension/expulsion review by Supt.

Lack of Effort:

First Offense: ASD ( 1 - 5)

Lying/Misrepresenting the Truth:

First Offense: ASD (1 - 5)

Second Offense: ASD (2 - 5)

Third Offense: OSS (1 - 5)

Fourth Offense: OSS up to 10 days

Malicious Statements:

Malicious, slanderous, provocative or inflammatory remarks towards another student.

First Offense: ASD (1 - 5)

Second Offense: ASD (2 - 5)

Third Offense: OSS (1 - 5)

Fourth Offense: OSS up to 10 days

Physical Assault of School Personnel:

First Offense: 10 OSS plus long term suspension/expulsion review by Supt.

Sale/Distribution/Possession of Pornography:

First Offense: Confiscation Up to 10 days OSS

Second Offense: Confiscation 1-10 OSS pending long term OSS review by Supt.

Possession of Stolen Property:

First Offense: Restitution and ASD (1 - 5)

Second Offense: Restitution and ASD (2 - 5)

Third Offense: Restitution and OSS (1 - 5)

Fourth Offense: Restitution and OSS up to 10 days

Under the Influence of Drugs/Alcohol at School:

First Offense: 1 unexcused absence for the parents to be notified so a physician diagnosis can be made and returned to the school and 1-10 OSS plus both the parents and student must conference with administration and report to police officials

Second Offense: 1-10 OSS pending long term suspension review by Supt. and report to police officials

Third Offense: Immediate OSS and report to law enforcement officials plus long term suspension review by the Supt.

Profanity/Racial Slurs/Obscenity-verbally or with gestures:

First Offense: Minor: ASD (1 - 5) Major: OSS 

Second Offense: Minor: ASD (2 - 5) Major: Minimum 1-3 OSS

Third Offense: Minor: Minimum OSS (1 - 5) Major: Minimum 5 OSS

Public Display of Affection:

First Offense: Conference

Second Offense: ASD (1 - 5)

Third Offense: ASD (2 - 5)

Fourth Offense: OSS (1 - 5)

Sexual Harassment: Occurs when a person has been illegally discriminated against. Unwelcome sexual advances, unwelcome request for sexual favors and other unwelcome verbal, nonverbal, or physical conduct of a sexual nature are examples of sexual harassment. These discriminatory actions cause a hostile learning environment to exist and hinder instruction.

First Offense: Verbal, written or symbolic: ASD (3 - 5) Physical: 1-10 OSS and report to police officials

Second Offense: Verbal, written or symbolic: ASD (3 - 5) Physical: 1-10 OSS and report to police officials

Third Offense: Verbal, written or symbolic: 1-10 OSS Physical: 1-10 OSS pending long term OSS review by Supt. and report to police officials

Fourth Offense: 1-10 OSS pending long term OSS review by Supt. and report to police officials

Stealing/Theft:

First Offense: Pay for or replace items and 1-3 OSS plus a possible call to police

Second Offense: Pay for or replace items and 3-5 OSS plus a possible call to police

Third Offense: Pay for or replace items and 1-10 OSS pending long term OSS review by Supt. and report to police officials

Tampering:  The unauthorized tampering of entry into a locker, desk, bag, vehicle or other’s personal property assigned to or belonging to another individual or the school.

First Offense: Restitution and ASD (1 - 5)

Second Offense: Restitution and ASD (2 - 5)

Third Offense: Restitution and OSS (1 - 5)

Fourth Offense: Restitution and OSS up to 10 days

Tardiness:

First Offense: First and Second tardy - Classroom warning and or consequences

Second Offense: 3rd and 4th tardy – one 30 minute ASD

Third Offense: 5th and all additional tardies – 1 hour ASD

Threats/Intimidation:

First Offense: Minor: ASD (1 - 5) Major: Minimum  OSS (1 - 3)

Second Offense: Minor: ASD (2 - 5) Major: 5 OSS

Third Offense: 10 OSS plus long term suspension/expulsion review by Supt.

Tobacco Violation:

First Offense: Confiscation ASD (1 - 5)

Second Offense: Confiscation OSS (1 - 3)

Third Offense: Confiscation Up to 10 days OSS

Fourth Offense: Confiscation 10 OSS plus long term suspension review by Supt.

Trespassing:

First Offense: ASD (1 - 5) Possible notification of Law Enforcement

Second Offense: OSS up to 10 days, notification of Law enforcement

Third Offense: OSS up to 10 days, notification of Law enforcement plus long term suspension review by Supt.

Truancy: Includes being in an unauthorized location on campus; being somewhere without permission.

First Offense: On campus: 1 ASD Off campus: ASD (3 - 5)

Second Offense: On: ASD (3 - 5) Off: OSS (1 - 3)

Third Offense: On: ASD (3 - 5) Off: OSS (1 - 3)

Fourth Offense: On: OSS (1 - 3) Off: OSS (3 – 5)

Possession/Distribution of Drugs or Alcohol on School Grounds:

First Offense: 1-10 OSS and call to parent pending long-term suspension review by supt.

Notification of Law Enforcement

Second Offense: 1-10 OSS and call to parent to come get student, pending long-term suspension review by supt.

Notification of Law Enforcement

Third Offense: OSS long term with parent and student meeting with BOE

Notification of Law Enforcement

Unsatisfactory Bus Conduct:

First Offense: Minor: ASD Major: ASD (2 - 5) & assigned seat until further notice

Second Offense: Minor: ASD (1 - 5) and Front row seating 2 weeks Major: 5 Days off bus

Third Offense: Minor: 3 days off bus  Major: 10 days off bus

Fourth Offense: Meeting with bus driver, principal, student and parents with possible permanent bus suspension

Vandalism:

First Offense: Restitution and 1-10 OSS depending on severity

Second Offense: Restitution and 1-10 OSS pending long term suspension review by Supt and report to police officials

Verbal abuse of or threats against staff member:

First Offense: 3-10 OSS and report to police officials

Second Offense: 1-10 OSS pending long term suspension/expulsion review by Supt and report to police officials

Violation of Coach/Sponsor Standards of Conduct:  Conduct in violation of reasonable rules and requirements established and announced by coaches or sponsors of school activities beyond the standards of conduct herein provided.

First Offense: Possible suspension from the activity.

Law Violation: In addition to the previous standards, any act identified by Missouri Statute as a crime is a violation of these standards and may be dealt with as provided by law.

First Offense: Referral to appropriate authorities
